- Acceptance of Terms
These Terms of Service (“Terms”) govern access to and use of Zuant’s website, products and services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Services.
- Company Information
The Services are provided by High Performance Software Ltd., trading name Zuant (“Company”, “we”, “us”, or “our”).
- Eligibility
You must be at least 18 years old and have the authority to enter into legally binding agreements to use the Services.
- Use of Services
You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not:
- Use the Services for any unlawful or fraudulent purpose
- Attempt to gain unauthorized access to systems or data
- Interfere with or disrupt the integrity or performance of the Services
- Upload malicious code or harmful content
- Violate applicable laws or regulations
- Account Responsibilities
In signing up for a Zuant account, you are responsible for the following:
- All user activity within your account
- Maintaining the confidentiality of all user credentials associated with your account
- Notifying us immediately of any unauthorised access to your account
- Intellectual Property
All content, software and materials provided through the Services are owned by Zuant and its licensors and protected by Intellectual Property Laws.
You may not copy, modify, distribute, or create derivative works without prior written permission.
- Confidentiality
You agree not to disclose any confidential information obtained through use of the Services without prior authorization.
- Data Protection and Privacy
Your use of the Services is also governed by our Privacy Policy, which explains how we collect and process Personal Data.
- Third-Party Services
The Services may include integrations with third-party providers. Zuant is not responsible for third-party services or their availability.
- Service Availability
We aim to provide reliable Services, but do not guarantee uninterrupted or error-free operation. Maintenance, updates and technical issues may result in downtime.
- Limitation of Liability
To the maximum extent permitted by law:
- The Services are provided “as is” and “as available”
- Zuant disclaims all warranties, express or implied
- Zuant shall not be liable for indirect, incidental, or consequential damages
- Total liability shall not exceed fees paid for the Services in the preceding 12 months
- Indemnification
You agree to indemnify and hold harmless Zuant from claims arising from:
- Your use of the Services
- Violation of these Terms
- Violation of applicable laws
- Termination
We may suspend or terminate access to the Services:
- For violation of these Terms
- For security reasons
- If required by law
You may terminate use at any time in accordance with your Client Agreement.
- Changes to Terms
We may update these Terms periodically. Updates will be posted on this page with a revised “Last Updated” date.
Continued use after changes constitutes acceptance.
- Governing Law
This Agreement shall be subject to the substantive laws of England and Wales and the jurisdiction of the English High Court.
